The second video is of the NYPD responding and engaging the suspect and shooting him in front of the church. The video is edited on YouTube due to their policies, however it is unedited here.

In NE a CCW cannot cover with a drawn firearm. If you pull out the gun, you better use it. There is a very slim time frame where an aggressor can stop their attack and then the CCW must immediately reholster. Outside that, it is brandishing a weapon. I'm not saying what I would do, I'm just stating the law. Know the laws of your jurisdiction.
